Welcome to Gothi Tech LLP! These Terms and Conditions ("Terms") govern your use of our AI Chatbot services, website, and related software (collectively, the "Service"). The Service is owned and operated by Gothi Tech LLP ("we," "us," or "our").

Please read these Terms carefully. By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Our Service provides users with access to an advanced Agentic AI chatbot platform that processes user-provided content ("Content") to generate responses ("Output"). The Service integrates with and utilizes third-party AI models from providers such as Google (Gemini), OpenAI (GPT-4o), Anthropic (Claude), and DeepSeek, and is hosted on Amazon Web Services (AWS).

2. User Accounts

To access the Service, you must register for an account. You may register directly or through a third-party service like Google or Microsoft. You agree to provide accurate and complete information and to keep this information up to date.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at privacy@voixt.ai of any unauthorized use of your account.

3. Subscriptions, Payments, and Free Trial

Free Trial: We offer a one-time 7-day free trial for each of our subscription packages. The trial begins on the day you sign up for a specific package. You will be required to provide payment information to start the trial.

Automatic Billing: Upon the conclusion of your 7-day free trial, your account will automatically be converted to a paid subscription, and your provided payment method will be charged for the selected package fee unless you cancel your trial before it ends.

Subscription Plans: Our services are offered on a subscription basis. Fees are billed in advance on a recurring monthly or annual cycle. Details of our packages and pricing are available on our pricing page.

Cancellations: You may cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current billing cycle.

Refund Policy: Subscription fees are non-refundable except as required by law or as explicitly stated otherwise by us.

4. User Content and Ownership

Your Content: You retain all ownership rights to the Content you submit to the Service.

Our License to Your Content: To operate and provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, reproduce, and display your Content solely for the purpose of providing and improving the Service for you.

AI-Generated Output: As between you and Gothi Tech LLP, you own all rights, title, and interest in and to the Output generated by the Service based on your Content. You are responsible for ensuring that your use of the Output complies with all applicable laws and these Terms.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law.
• Upload or generate any content that is unlawful, harmful, defamatory, obscene, infringing, harassing, or hateful.
• Engage in or promote any activity that is fraudulent or misleading.
• Transmit any viruses, malware, or other malicious code.
• Attempt to reverse-engineer, decompile, or otherwise discover the source code of the Service.
• Infringe upon the intellectual property rights of others.

We reserve the right to suspend or terminate your account immediately if you violate this Acceptable Use Policy.

6. Intellectual Property

All rights, title, and interest in and to the Service itself, including its software, code, branding, logos, and design, are and will remain the exclusive property of Gothi Tech LLP. These Terms do not grant you any right to use our branding or logos without our prior written consent.

7. Third-Party Services

The Service relies on third-party services, including but not limited to AWS, Google, OpenAI, Anthropic, and DeepSeek. You acknowledge that the Service's availability may be subject to the availability of these third-party services. We are not responsible or liable for any issues, downtime, or failures caused by these third parties.

8. Termination

You may terminate these Terms at any time by canceling your subscription and discontinuing your use of the Service.

We may suspend or terminate your access to the Service at any time, with or without cause, including for a violation of these Terms. Upon termination, your right to use the Service will cease immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT MAKE ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY OUTPUT GENERATED BY THE SERVICE. YOU ACKNOWLEDGE THAT AI MODELS CAN PRODUCE INACCURATE OR OBJECTIONABLE CONTENT AND YOU AGREE TO USE THE OUTPUT AT YOUR OWN RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GOTHI TECH LLP, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Ahmedabad, Gujarat, India, and the parties irrevocably consent to the personal jurisdiction and venue therein.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
